Heboh Pengakuan Gatot Nurmantyo, “Saya Buka Ini untuk Adik-adik Saya”
Jiwapatriot.com - Panglima TNI Jenderal Gatot Nurmantyo membuat pengakuan mengejutkan. Gatot mengaku saat ini dia tidak bisa leluasa melakukan pengawasan terhadap perencanaan dan penggunaan anggaran di setiap angkatan.
Kewenangan Gatot sebagai pucuk pimpinan TNI dipangkas sejak terbitnya Peraturan Menteri Pertahanan (Permenhan) Nomor 28 Tahun 2015.
Soal anggaran, misalnya, tahun ini Polri mendapatkan Rp 84 triliun. Sedangkan TNI memperoleh Rp 108 triliun untuk lima instansi. Masing-masing Mabes TNI, Angkatan Darat (AD), Angkatan Laut (AL), Angkatan Udara (AU), dan Kementerian Pertahanan (Kemenhan).
Gatot menjelaskan, anggaran belanja barang Mabes TNI dialokasikan Rp 4,8 triliun. Dia tidak menjelaskan perihal anggaran AD, AL, dan AU. Menurut Gatot, kedudukan panglima TNI sekarang sama dengan detasemen Mabes TNI. Dia tidak lagi mengendalikan AD, AL, dan AU “Kewenangan saya tidak ada,” katanya dalam rapat dengar pendapat dengan Komisi I DPR di Senayan kemarin.
Kewenangan panglima TNI dipangkas setelah muncul Permenhan 28/2015 tentang Sistem Perencanaan Pembangunan Pertahanan Negara. Peraturan itu dinilai bertentangan dengan UU 34/2004 tentang TNI.
Gatot menerangkan, Permenhan 28/2015 meniadakan tugas, kewajiban, atau wewenang TNI untuk membuat rencana kerja dan anggaran (RKA). Dalam hal penganggaran, panglima TNI berkedudukan sama dengan kepala unit organisasi (UO) angkatan karena hanya diberi tanggung jawab UO Mabes TNI.
Menurut Gatot, jalur pengajuan dari UO angkatan langsung ke Kemenhan sejatinya meniadakan TNI. Tidak ada lagi wewenang panglima TNI untuk membuat kebijakan prioritas penganggaran.
“Termasuk proporsionalitas antar angkatan,” ucap mantan KSAD itu. Dengan aturan tersebut, panglima TNI sulit bertanggung jawab dalam pengendalian penggunaan anggaran.
Gatot juga memaparkan poin-poin dalam permenhan yang melanggar atau bertentangan dengan UU 34/2004. Dalam hal kebijakan dan strategi pertahanan, pasal 3 UU 34/2004 menyatakan bahwa TNI berada di bawah Kemenhan. Sedangkan dalam permenhan disebutkan, UO angkatan yang berada di bawah Kemenhan.
Selain itu, dalam permenhan disebutkan, pengajuan RKA dilakukan langsung dari UO angkatan ke Kemenhan.
“TNI tidak punya lagi kewenangan mengontrol RKA UO angkatan,” kata Gatot.
Hal itu bertentangan dengan pasal 4 UU 34/2004 yang menyebutkan bahwa TNI terdiri atas AD, AL, dan AU yang melakukan tugas secara matra atau gabungan di bawah panglima TNI.
Gatot menegaskan harus mengungkap masalah tersebut demi kepentingan penerusnya.
“Saya buka ini untuk persiapan adik-adik saya. Saya mungkin besok bisa diganti,” ujar jenderal yang pernah menjabat Pangdam V/Brawijaya itu. Jika hal tersebut terus terjadi, kewenangan di bawah panglima TNI tidak ada lagi.
Paparan panglima TNI direspons DPR. Anggota Komisi I Effendi Simbolon mempertanyakan perubahan aturan itu. “Bisa nggak kami mendapatkan penjelasan dari Menhan dasar perubahan itu?” katanya.
Menhan Ryamizard Ryacudu menyanggupi. Namun, dia meminta rapat tertutup. “Kalau tertutup, kita buka-bukaan,” ujarnya. Para jurnalis pun diminta keluar ruang rapat.
Anggota Komisi I Andreas Hugo Pareira meminta penjelasan lebih detail terkait masalah tersebut. Tapi, karena belum memiliki bahan yang cukup, rapat ditunda. DPR mengagendakan rapat lanjutan untuk memberikan penjelasan yang komprehensif.
“Kita coba sinkronkan. Jangan sampai melanggar undang-undang yang menimbulkan friksi,” tuturnya.

Be prepared to pay heavy fines
Earlier, the Motor Vehicles Act, 1988 governed the road safety and traffic rules. Recently, the Government passed the Road Transport and Safety Bill 2014 to replace the Motor Vehicles Act, 1988. Among other changes, the Bill penalizes you heavily if you are caught driving without having a valid insurance cover. As per the amendments, you would have to part with a whopping Rs.25, 000 for a light motor vehicles or Rs.75, 000 for other motor vehicles as a fine for driving without insurance. A huge fine, isn’t it?
Pay losses for damages caused to third party or property
In an accident, if you unintentionally harm any person or surrounding property, you are liable to pay the loss incurred. This is called third party liability. Your car insurance mandatorily covers this third party liability and spares you the loss incurred. In the absence of a valid insurance cover, you would have to bear the losses incurred. If the person dies, your liability would be very high.

Pay losses for own damage
While you have to compulsorily pay losses caused to a third party, what about your losses. In an accident even your vehicle suffers damage. The costs of repairs for such damage are borne by your comprehensive car insurance policy. Without insurance, the onus of paying for the repairs is on you. With the high cost associated with the repairs of your car, a financial strain is inevitable.

Face legal complications
Besides the financial loss suffered in an accident which causes damage to a third party and/or self, you would also be entangled in legal complications if your car is found without a valid insurance cover. You would be penalized, get a challan and might even be imprisoned.
Loss of No Claim Bonus
If your car insurance expires and you do not renew it, besides the penalties and fines, you also lose the No Claim Bonus which you accumulated in your existing policy. Car insurance plans allow a discount in subsequent year’s premiums if there is no claim in any current year. This discount increases every year and saves your premium outgo. If you let your car insurance policy lapse, you lose the accumulated NCB and end up paying a higher premium when the policy is consequently renewed.
A car insurance policy is legally mandatory and not having one results in serious consequences (as mentioned above). While a third party liability cover is mandatory, a comprehensive policy is better. The former pays only for the damages caused to any third party but the latter also covers damages incurred by you and your car. The premium for a comprehensive policy is slightly higher because of higher coverage. For instance, the premium payable for a Maruti Ritz car registered in 2012 having a capacity of 1197cc would have a third party premium of Rs.2237 and a comprehensive premium of Rs.4200 (approximately). With a slight increase in the premium you can avail a higher coverage option which covers for your damages too. Since car repairs are expensive, a comprehensive policy makes more sense even if the premiums are a little high. So do not fall a victim to these consequences and buy an insurance policy for your car today.
